HELP NEEDED!!!!

Guys in aug id a slight tip in my car, got it fixed, then clutch went, got that fixed but synchro is going between 3rd and 4th, so basically enuff was enuff, guy offered me a swap against a civic type r, i took it and when driving home he rang me to say it had over-heated and wanted me to take it bak! claims head gasket is slight;y gone his SPECIALIST looked to over and said this then apparantly cranks fuked and then apparently wrong grade of oil is used in it....10w 40!?? claims he'll bring me to court unless i take it bak i think im gonna...any advice!?
 
It's up to you man a used car is "sold as seen" what if the civic had packed up on the way home, :doh:

Do you think he would take it back..... Always bring them to someone who know's what they are at
to have a look over them, don't think he has a leg to stand on if he want's to take you to court....
 
Well if your saying he rang within a half hour then yeah you should defo take it back. Different if he rang a week or month later he be told where to go...
 
even if he has bought the car from you privately he has the same rights as if he had bought it from garage.....so that means a warranty.
 
isn't there some latin saying in legal law, which basically means it's up to the buyer to get it checked out before he/she hands over cash. i think he has nothing to stand on, and how could overheat within 30mins unless he was abusing it. my 2 cents, wudn't like it done to me but i would have had it checked out by my 'specialist' before i handed over cash

interesting line this one " When buying from a dealer the Law says that a car must be of Satisfactory Quality and that a warranty must be provided". Some places don't give a warrentty .. sorry for going off topic there.
 
Was there any paperwork/receipts?? As in both of you signed swapped as seen with no comebacks etc???

@555-scooby Saying that a private buyer gets a warranty by law is a very mis-leading to people not to much into sales on cars.

Caveat Emptor. As far as I knew you are under no obligation to take the car back. He bought it as seen.
 
you have rights no matter where you buy your car from.......this is a fact davelegacy........give the ombudsman a ring.
 
Sale of Goods act does not apply to private sales as far as I know. For private car sales the term buyer beware is in effect. As soon as he bought it its his responsibility. It's up to the buyer to check the car. BUT if he did buy it on a lie that you told him or if you misled him then he can sue you.

These must also be of merchantable quality but the standards are lower. If you buy something through a private sale, your rights are greatly diminished. Goods do not have to be of merchantable quality, they merely have to be owned by the seller and fit their description. It is up to you to check out the goods before buying.

Unless otherwise told you buy as seen, there fore you aint got no come back, morale of the story is, check it out b4 ya buy it or get them to sign a reciept that they will give ya a waranty of some sort
 
i told him bout the crash and the fact synchro between 3rd an 4th was going, he's a mechanic himself apparently!! :lol: he said wen driving car was fine but wen sitting ticking over temp raises!? he said head gasket is slightly gone...then he said crank was knackered! it never over heated whilst i had it and wont come up to my place to collect car like i asked!which sounds suspicious to me!! wants to meet me at my wrk place!

we jus swapped log books!no cash no nothing
 
In the past i have sold alot of second hand cars and swapped on occasions,unless both parties have verbally or written something on paper,there is no obligation to swap back,only done as a guesture of goodwill.I got stung on a car i bought from the buy and sell a year ago.Looked fine to me,traded it in to garage for my current scooby,3-4 days later got a phone call from the garage to say that the car i traded in was in a serious accident a few months back and did i know anything about it,obviously not, as damage could only been seen on ramps.3-4 days previously,the salesman had checked out the car,test drove it and said.....very tight car mate....... Paperwork had already been sent etc and nothing the garage could really do unless i agreed to swap back.
2 years ago i had bought a 01 galant and found out from a bit of investigating that it had not got 55k,but actually had 127k on it before the garage had bought it fron Merlin auctions.On this occasson i got my money back and some.
Bottom line is ,if you bought/sold privately,there is no legislation to say that you are responsible.unless you knowingly knew something was wrong and sold it promising it was 100%,this also is impossible for the other party to prove
