Is your local County Council Liable?

Interesting conversation brought up over the coffee this morning, if you hit a pot hole on the road that has all ready been repaired buy the local cc, then are they are liable for any damage caused to your car.
I have a road outside my house that is more like Main Street Baghdad, and we all know how crappy some of the main roads are.

Bearing in mind that Meath county council, have already pleaded guilty for their part in the bus crash 2 years ago, Is this going to be a chance for the motorist to fight back, after all what is car tax meant to be used for (ok in part for) the up keep of the roads…well if the roads are breaking your car and you are paying your tax, then you are getting a faulty product…. :ponder:

I read before that a Council will pay out on damage to a car e.g. cracked wheel rim etc, if it has already been reported to them that another car has suffered damage also. The problem you have here is that how would you know if another car has been damaged & reported it to them perviously  :ponder:

They take this course of action as they are not liable for the first accident, but once informed and they nothing about it, they are liable for the second & subsequent accidents.

I do not know exactly if this applies to a repair recently carried out, but I would be fairly sure that the same "rules" apply  :thumbsup:

is proving it . so loads of pic's of car
pothole damge to wheel, tyre and then
off to the smalls claims court.

my mate busted one of his wheels off a pothole, the cc had it repaired before he could get pics of the pothole that done the damage. nothing he could do.

You don't need to see a sign telling you that you've just crossed into another county, it's usually obvious from the much better road surface!  :lol:
 
The roads in Meath are truly appauling.

The legal concepts non-feasance and mis-feasance govern Local Authority liability. Basically a local authority is not liable for damage caused to a vehicle (say "vee-heckle") because of a pot hole which has appeared gradually over time (non-feasance) but they are liable for damage caused by road works/repairs (mis-feasance). They have a statute of limitations of 24 months so get your claim into the roads section of your local authoirity before this time limit expires or your claim will be rejected.

All claims against local authorities are defended by Irish Mutual Public Bodies Insurance and a bigger shower of w*****s you will not meet in this lifetime or another!
