First of all I am sorry to hear you have been miss-sold a car in "damage repaired" condition, without you knowing
If you have been sold a car by a car dealer registered with the SIMI and it turns out that they have lied or have hidden the truth with regards to the condition during the sale process....you have two avenues which you can explore
:
Consumer Rights Act
The car was "mis-sold", as it was sold / bought on the premise that it was not damaged previously.
(A car dealer is LEGALLY OBLIGED to inform all prospective buyers of prior damage repairs to a vehicle, whilst conducting a sale. If they do not inform the sale time they are acting illegally
) As they have admitted following the sale that they knew / done some of the repair work, they really do not have a leg to stand on.......
Report the Garage to the SIMI
The SIMI operate on a code of ethics, if the dealer is found to be in breach of these ethics, they could have their membership revoked. How would that look for a car sold under a "Gold Standard"
Again if he has admitted that they have carried out damage repairs to the car and not informed you during the sale process..... they are in breach of their SIMI standards also
I know the SIMI are only an association, but they may be a cheaper option to explore before you go legal
"Frawls" on the forum may be able to help you out also, he is a solicitor and should be able to give a legal opinion on the above
