Speeding

Lad's a friend of mine :whistle: just got done for speeding 97km in a 60km.
Just got a call off the garda to ask what way he will be pleeding guilty or not
he told the garda guilty then the garda told him that he would not be at the court
for the hearing but another garda would take his place.Has anyone ever had this happen to them.
Is there a way out of this maybe pleed not guilty and with the garda not there it will get fooked out????

Eh forget about the court bit first of all?????????

Have never EVER heard a gaurd calling you to ask wat you plead............... this country is fooked.........
 
bein in court enough times and never got a phone call somethin up with that
 
In fact never heard of a garda asking for your phone number????????  and if i did certainly they would not get it as would have no business asking...........

Hes been there enough times with me during Garda above themselves type things that i'd usualy make their ears bleed before do anything for them....... total out of order and not common practice.........

I think the judge will throw the case out if knows that?! :dunno:
 
Gardai ringing to get the verdict :ponder: thats a first and none of there business. Was it a speed gun they got you / him with and do they have proof ?

I emailed a friend form college who is a solicitor now and this is what they came back with;
I could be wrong, and I’ve asked someone who does District Court work for a definite answer, but I think Garda has to be there in question to give evidence of what he saw and why he gave the ticket.
If person has a solicitor, it’s totally inappropriate for Garda to contact directly.
Will come back to you when I hear for sure.

nothing wrong with this!

if the cop hadnt rang him and had another garda appear in place then the judge would strick out the summons because the garda failed to inform the defendant he wouldnt be there
but by ringing him and informin him of his absence..and the guilty plea entered by the defendant..the judge can deal with the summons on the day with the stand in garda givin facts of the case

happens the whole time in the summons cts

The Garda would have to be there himself/herself if the matter was to be

contested. In the event that it was a plea, another Garda or State Solicitor could deal with it by simply outlining the facts.

Unfortunately, it's not unusual for a Garda to make direct contact to see how a person intends to deal with the case.
