Adamant I had right of way here!

Just in the door after coming home from the M1. Basically as I was coming off the slip road to use the rounadbout at the top of the off ramp there was a couple cars coming from the right so I had come to a complete stop at the white line at the top of the ramp to give them way on the roundabout.

My path was then clear and I double checked and continued on. Then all of a sudden I heard skidding and someone holding their horn. I look to my right and a Taxi is skidding up to my door from my right.

I'd just started turning the wheel to get around the roundabout so I hit the brakes and stop dead with no skidding, even in the wet weather we're having. The Taxi must have stopped no more than 7 or 8 inches from my door. Both of us got out and he start roaring abuse asking WTF I was at and he was going to call the Gardaí and he had righr of way.

Now, I know for a fact he was not there when I double checked and I'm adamant I had the right of way for a couple of reasons.

1. I had already entered the roundabout and was well clear of the white line at my section of the junction that indicates me to yield and the rules of the road dictate traffic that is on a roundabout has the right of way. As I'm there before him, I have right of way.

2. He must have been absolutely planting it aswell as not paying attention.

His road is a 60kph speed zone, people coming off the motorway are coming from a limit of 120kph. Even though people coming from the motorway should stop, the person in the 60kph zone should be mindful of the other motorists coming from 120kph and you'll always get the nut case that bulls through the roundabout from the 120 zone not giving a balls to other road users. So, it's far easier to foresee this and be expectant of it and be prepared to stop if you're in the 60 zone. That's how I always approach roundabouts with this layout anyway.

Long story short, I told him to ring the guards and I'd have fun watching him explain how he managed to skid to a stop coming from a 60 and there was absolutely no skids from my car coming from a 120 and the positions of our cars showed I was on the rounadbout well before him and he was the one who nearly came into the side of me.

Am I right or wrong in this instance? Opinions welcome.

Well if it was clear for you to enter the roundabout, then you were right to do so.
Taxi drivers are dicks, they think they own the road.

If you where stopped to leave right of way to vehicles already on the roundabout and continued when there where no vehicles coming from your right then you acted in accordance with the law! Now if he was exceeding the specified speed limit and approached in an uncontrolled manner then he is in the wrong no matter who had right of way!!!
The only thing you did wrong was stop on the roundabout and exit the vehicle!!!
Whilst i understand you Are in the right and that you where only defending yourself from a noble head, if another vehicle had hit the taxi from behind then technically it could be argued in court that you caused the accident

in future don't give dip sits like that any credence and continue on your way!!

Heat of the moment Hammie but definitely see what you're saying! You have to at least come to a crawl approaching the top of the off ramp because there's hedgegrow right the way up making it impossible to see anything approaching the roundabout on the fly over.

once your car was fully on the roundabout you have right of way i found that out to my cost in an accident a few years ago

Know the junction well and I'd be always coming across the flyover to head northbound. While its very easy to catch someone out who is coming up the slip road and entering the roundabout, I know they can't see very well and its never been anywhere close to an accident as a slight touch on the brakes gives plenty of space for them to get around the roundabout.

The only thing I can think is that your man must have been absolutely hammering it across the flyover and from what you've descibed, he could only have been going straight on, not turning onto the motorway as there'd be no way he could make the turn at that sort of speed where he could have slowed down just enough to make it straight on with a quick left right left flick of the wheel...

That's what I thought but nope, he went down onto the motorway. How he was expecting his Skoda to be able to make that kind of turn at that kind of speed with the road conditions just amazed me! :shock2: Feckin nut case! I don't drive the Integra on when I'm on the roads. The only time I did push her on was when we were going over the mountains and when I'm at Mondello. Other than that I drive like a granny in it. Which is evident from the MPG I get out of it!

vast majority of taxi drivers and cyclists think they have a divine wright to do what they like on the road , they just pull in and out of lanes without even looking and as for taxis and speed limits ,forget it , they see speed limits as suggestions , really broke my hole laughing at a 3 taxi pile up near dolphins barn a few weeks ago , 3 of them were in the right though lol , but still had managed to crash into each other. they were only screaming at each other .

but was anyone hit?

I always understood that the hitter was the guilty one whether hitting the back or the side of a car?

only thought that apllied if you hit from the rear
as you should be able to brake at all times

I have yet to see in general more than 2 or 3 people who know how to use a roundabout and the ones that dont, really dont care they move from lane to lane on even the biggest roundabouts so its up to you to think for a lot of them cheers.
