Sorry to hear that Niall. Give me a call at work on Monday 01- 4965170 and we'll go through it. If the other guy is not admitting liability then your insurer will have to sue his insurer and him to receover the loss. If he is claiming against you, your insurer will defend the claim and appoint a Solicitor from their panel. If the other guy is claiming personal injuries he must initiate his claim in the Personal Injuries Assesment Board (PIAB) within 2 years of the accident (the same goes for you). Again, your insurer will defend the action. If he is prosecuted for Dangerous driving this is not admissible in a civil action but it can be mentioned without introducing it in formal evidence. Most charges of dangerous driving are pleaded down to a lesser offence as the offence of Dangerous Driving is usually only brought by the DPP where there has been serious injuries involved as the penalties are so severe.
Your Insurer will not reduce your premium where a claim is pending and it is unlikely any other insurer will touch you either so you will be better off staying with them for the moment. Check your policy details carefully regarding replacement vehicles. If you have fully comp cover then liability should not be an issue as regards repairing your car but your premium will remain elevated until the claim is settled.
Dont forget modifications void your insurance cover so it's just as well you never laid a finger on your car. When the insurer assessors call out to see your you should have nothing to worry about as all they will find is a standard Type R if you know what I mean so get cracking if you haven't already.
