AGGHHHhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhh!!!!!!!!!!

sorry to hear this lad i almost ran the pr*** in question down 2nite when he was getting out of his old fellas merc cls320 but i missed him sorry new_2gunsfiring_v1

Thanks Rob..............

The plot thickens: :angry1: I found out yesterday evening from the Garda in question that the DPP
ARE NOT GOING AHEAD with the charge of dangerous driving.
He said the reason been because there was a broken white line , The thrid party was entitled to be
overtaking and i should have used more caution exiting onto a main road :cuckoo: :cuckoo:................Or at least that's what the DPP
said. The Garda was apologising and urged me to stick with the civil case and that he would back me all the way etc.........

The bit that's driving me insane is that he furnished this information to Both Insurance Company's and my broker weeks ago.
Hence the big fook off claim for €23,500 :new_2gunsfiring_v1:

It Would of been nice if some had decided to pass on the info :wall:

I swear to God, i feel like im starring in "Deliverance Part II" and im the one been bent over the the tree trunk :mooner:

Anyway my Insurance Company are still backing me but by the way they are talking i reckon it will be settled
out of court prob 80% / 20% in my favour maybe NOT ????

Im meeting with my own solicitor again on Tuesday so hopefully he might have some better news.

So if yer man found in wrong as he was is the insurance company going to refund you the hike difference?

Well first they told me NO !!!
Then they said i would have to get that back from the thrid party,
And finally when i pushed them on this...... guess what, YES !!!! they have to pay it back..................FUCKEN RETARDS

From what i have been told it's very hard to get them to pay this .

Niall.

If he is claiming he is claiming for personal injurey so photograph the lad and but a stop to it with your solicitor. Send his insurance and solicitor a few pics of him not injured.

Very hard luck man...im only 23 but had an accisent back in 2005 there when i was on my old mans policy...really messy!!!!

I was not at fault in a 4 car pile up (i was the third) and i was shunted into the 2nd car from the 4th!!!

It took until february this year to settle yer mans personal injury and it was out of court and when i say that it was at the steps of the court

and im not bullsh1ting!!!!literally at the door awaiting to go in!!!

What happens is they hike yer premium so as to cover or recoup any short term expenses such as fixing your car etc and this will not be

refunded in any way regardles of the outcome unless it is settled before the next renewal and when your

renewal comes they will quote you based on a claim outstanding AND they will take your ncb as a result starting you off at zero again

*You had better check that when the case is settled (lets say in 2 years time) that your no claims bonus does not go back

to 0 again..as was in my dad's case even though you

a) wont be at fault and
b) will be cleared of any liability,

the fact that there is a "claim" on your policy, it affects you....Its like if someone hits your parked car and

tries to claim a personal injury, its your ncb thats effected regardless of the outcome...

Sorry to be bearing bad news but this has happend to me and only that it was on my dad's policy, i wouldnt have been

able to insure the type r insured atal.

Also it may not hurt to put in a counter claim to his insurers, although the ethics of that are all wrong if your actually ok.

Id also maybe give free legal aid a buzz, its free and often they will steer you in the right drection as opposed to being left on hold for solicitors and tole theyre in court or on holidays or any of the classic fob offs they use...

It is now a criminal offence to make a fradulent claim and I dont know what Solicitor you dealt with before but they dont sit by the phone all day waiting for you to call as they have 100's of clients to look after but he/she should call you back before close of business at least, the same as any other person in business would be expected to.

FLAC is for people who canot afford their own legal representation. A FLAC Solicitor is appointed upon application to the court. They are not a free legal advice bureau.

Anyway, Niall has engaged a Solicitor now so I'm sure he's being well advised now.

The only thing I would add is that I would recommend Niall to get a letter from his Insurer to confirm that in the even that his counterclaim/defence is successful he will be reimbursed his additional premium in full and that his NCB will not be affected.
