Just a quick question lads im renting a house since october and since the budget i cant afford the rent i gave my landlord my notice to finish the lease and he wont refund my deposit he said its because i didnt finish the year. Does anyone know anything about this as i genuinely cant afford the rent and the landlord is trying to rob me of my 1000euro deposit.

Please help!!!!!!!!!!!!!!
 
I'm a landlord, as ling as ya give 1 months notice or vice versa you should be fine, check your lease agreement. If he persists threaten him with the PRTB, he will sh*t himself and back down. Is he an official landlord? If he is not ur in the drivin seat. Even if he is officially you need to give 1 months notice unless u signed something different in the lease agreement
 
If you committed to the year (contract signed for 12 months rent), and are now leaving early, technically you are breaking your contract and he is entitled to keep your deposit afaik. While yes, it is a pain in the hole, he is not trying to rob you, it is one of the many reason for having a deposit in the first place.

No chance he can renegotiate the rent for the remainder of the contract year? Spread the deposit money over the remaining months? e.g. if 5 months left, reduce the rent by €200 per month?

Depends on the contract, the longer your there the more notice you have to give.
If your breaking the contract, im fairly sure youl would have to pay till the end, but depends on how nice the landlord is.
 
Its a fixed term agreement and i gave him 28 days notice as stated in the PRTB website and he just said its to pay an estate agent to rent it out again
 
His problem, tell him your raising a dispute as you have given him the appropriate notice, he will back down. Happened to me and I had to let them go
 
read ur contract and see exactly what it says. Then you will know what course of action you can take
 
Put it this way , if he asked u to leave and gave u a months notice, would he give u 1000 euro to find somewhere else? Think not, u give him a months notice u have the right to ur deposit, if he won't give it back go to the PRTB
 
He signed a fixed term contract, why should he be able to walk away scot free? And the landlord could not legally ask him to leave for the same reason, the fixed term contract. The details should be in the contract anyway and he'll know then.

Firstly you would be best off to check your contract to see what are the implications & procedure are for an early termination :thumbsup:

Is your landlord legit & registered with the PRTB, if he is not and is acting the maggot get his PPS number and tell him you will be onto the revenue :thumbsup:

As above your contract is the first place to start :thumbsup:

Hello Gar,

Get onto Threshold website you will get all the info of the day on there. Just a we thing, did he prove you with a rent book? If not that is a rule breaker AFAIK as by law the landlord has to provide you with a rent book

Was reading the contract just there and there is noting on it about termination. Rent Book ???? He never gave me any rent book. Could i get my deposit back if i bring this up with the PRTB as he is a member of.

Hello Gar,

If he is a member of the PRTB & it is not mentioned in your contract about early termination then he must abide by their rules :thumbsup:

This should mean that one months notice is enough :ponder2:

The PRTB is a useless body IMO & take months to do anything, but I think that you can quote their rules of early termination as there is an absence of this issue on your contract :thumbsup:

The only thing is on the front of the contract it has ( BREAK CLAUSE OPTION: N/A) has this got anything to do with early termination??
