car dealer info

well i hav already had it up 2 my mechanic for the same prob and thought i had it sorted but its happened again all im gettin is me gettin pissed off so lookin into gettin a letter sent out 2 him but he needs 2 see the problem first but wit all ur help and info im feelin tat i cud get my money back well i hope so

By him offering 1k less, he is covering himself taking it back, he will have your 1k to patch her up for someone else.
The engine on the way out.. can you explain a bit more about that conclusion...
You could also go to Subaru, get them to price new engine and fitting etc etc, fixing all the problems, best get priced from 3 places, these of course will be big big estimates, you then can say full refund or he can pay to get car fixed by Subaru not by him ...
Anyway we are all offering blind advice here, go to Soliciter and problem will be sorted nifty... its a game at this stage.. he is saying how far he can push it and seeing are you bluffing.
In fairness to you, you are doing things the correct way by not naming them, i know i probably wouldnt have the same sense if it was me... if you go and put there name up now things could get legally messy if they wanted too, needless complication for you. Name them when you are sorted.

a lad in work had this problem lately. bought a car and it was pure junk.
i checked it in work and it needed 2000 to put it right.

between the jigs and reels,we told him throw it back and go legal.
he did this.the trader had no money to refund as he had paid overheads, staff etc with the money from sale of car.

so the lad in work was given a car from the trader to drive around foc untill the trader sold car.
3months later his old car was sold and he got his refund.

maybe try this route but get it signed on paper.

knew a guy who got a full refund on a 2003 bmw 318ci
he kept complaining about the car making a small thud noise when put in to reverse
everything that could be was replaced on the car
a brand new diff even :cuckoo:
sound was still there
eventually the car in question was brought to the best bmw mechanic in the country
his response was "they all do that "
customer still wasnt happy
so he was given a full refund
the garage in question was a simi garage
so im not entirely sure if the same applies for all garages
but i would guess you are entitled to a full refund
i wouldnt except less

So the trader just passed on the car to some other poor consumer?

well got some legal advice and was told 1, he can fix the problem 2, give me another car 3, refund my money so on 1, he does't want to put big money into fixing it so tats a no 2,did't really offer me another car and 3, he offered my a car worth 1500 and a grand but still out a grand so as he says he doe't have the full refund i think i'll be trying my solictor to help me out, and again guys thank you so much for your help and info it has helped me out so much thanks

well i've already said bout a refund and he said he did't see tat happenin but he must no tat i can get a refund, ask a few people and they said if he says no refund then get my soliciter on 2 him, i'd have 2 get a mechanic 2 come 2 my house as car can't move wud tat work 4 a report?

He's just admitted to selling you a faulty item. He doesn't get to choose whether you get a refund or repair, you do, it's within your statutory rights as a consumer to choose what you want. Don't believe this lark about him not having the money to give you back, demand your full amount back.

Get on to a solicitor. Definitely don't take part money and a car, it might be another lemon.

just do what i did get a 6 ft sign stating what a cowboy opperation it is and stand outside the garage
see how quickly you get sorted out then

ok was told by my friend who's a mechanic and was told head gasket is gone, and was told it would cost near a grand to get sorted so called the dealer and told him this so he said no way to paying tat much to fixing it and said my machanic was full ov sh*t with tat price, so i told him i wanted my money bak and tat i was onto my solictor and the consumer agency and tat got him even more mad at me so he said that was my biggest mistake by getting in touch with them both. and if it does go to court that he'd make sure i would'd get my money back and that all i'm intitled to was a repair and thats all i'd be getting. so lost again with what to do as was chatting to my solictor and she said to take his offer as if it did go to court that the judge would take his side, now i'm pissed off with her and am looking for a new solictor,

Right. When you buy from a garage your statutory rights come in to effect. The dealer does not, in any way shape or form, decide whether you get a refund, repair or replacement.

The decision is yours. His behaviour over the phone is just scare tactics to try get rid of you. A method every scumbag screwball wheeler dealer uses when sh*t hits the fun.

Get a better solicitor, take it to court, and nail this fucker to the wall. Me bollix will any judge take this cowboys side in court.

time to name and shame this knobgobbler i think

Careful now, he's only a knobgobbler if he's caught on his knees in front of someones crotch. However, I agree with name & shaming. :)

I would get a second opinion if i was you,
You must be entitled to your money back, if not at least you should have the choice of getting it fixed in Subaru...
Dont mind what ever this guys shites on about.. would you expect anything else????
And get a loan of that sign off Copperhead

I don't often agree with the name and shame tactic, however in this case he seems to be trying every intimidation tactic in the book!
Let's be honest here! If you employed me to plumb your house and I had 10 rads to hang and get working but 1 didn't heat at all and 1 kinda worked, would you let me away with it?
I'd say ye would be at my front door every day till I sorted it!
No reason not to treat the dealer the same way!!'
You paid for a product and in doing so you and the dealer entered an unwritten contract! You pay what he was asking and you get a working fully serviceable product or service!

This hasn't been the case so far, which means he has breached his end of the contract!
In this case his breach of contract means he is in breach of the trade descriptions act!

He hasnt a leg to stand on!!!!

I dealt with a fella similar before!!!!
They closed down not long after!!!!

sorry but not goin to name and shame just yet till i get this sorted just to be safe but does anyone no a good solictor? that would help me out. and just want to say thanks for all of your advise here guys and happy xmas to all of you
