Clamping... where do you stand??

Its a bit of a bug bear of mine, how someone who is not a Cop or Customs officer can do something to your car to immobilise it.
So where do you stand?
You come out car is clamped, nip into a plant hire shop around corner... Con saw please with steel cutting blade.. back in 5 mins. You cut it off... What Now??

For removing something that was attached to your car without your consent??? :angry1:
I disagree your Honour

Yea i was thinking the same.. when they come after you could always say HU What Clamp, my car wasnt clamped..
I wonder what is the legal standing on it do, Do you have to Legally pay to have them taken off or can you remove them yourself?

Honestly don't know, generally in the past, when a loop hole was found, it was quite quickly closed by the local authorities.

The solution is to have your car sitting on the tyres so they can't get the clamp over the top of the tyre and then you can just slide it out :icon_lol:

On a serious note though, I'd say if you were prepared to take it far enough and spend an absolute fortune, you'd probably win out. But thats a big risk and a lot of money for the sake of a small fine which you would have only gotten for parking illegally anyway :eek7:

once its done in a controlled fashion I wouldn't have a huge issue with it. with regard to their not having your consent, by an individual entering a private piece of land where the rules are signposted you are implicitly providing consent to the landowner or car park operator to clamp you if you don't obey the rules. not a popular opinion so I'm off to don my flak jacket. and I was clamped last year so I'm speaking having experienced the negative side of it

Id be of the same opinion as doggy
i know we all take chances occasionally but as a rule if you park properly in allocated spaces then you Are unlikely to have issues with clampers!

I have seen a few clamps being put on recently there the clampers have damaged the paint work of the car due to their ignorance and not giving. a cap!!! They where made to pay for the dmage. and the clamp was removed for free

Dunno if its the same here as the uk but, if you can remove the clamp without damaging it and return it to the clamping company as lost property you get away with it , might not be the same here though

As far as im aware, its quiet complicated lads. Under common law, the law of the land (eire). It is UNLAWFUL to impead someones private property. therefore as i would consider the clamper to be breaking the Law by impeading your private property(car).

Under statuate law, what they are doing is Legal as the goverment give them permission by drafting a statuate law. but it requires consent from the goverened before the act can be implemented. this is where they trick you into consent. by ringing them and confirming you are the REGISTERED owner of said vehicle you are entering a contract with them. if you dont ring them and enter that contract you can cut the clamp and you havnt done anything illegal

Were I live we used to have parking permits and clampers used to come in and clamp the ones that didn't have one so we used to cut them off and we now have a shed full of clamps and they actually called the gardai at one stage but gardai told them there was nothing they could do as it was private property that was 2 years ago and have heard nothing about it plus clampers don't bother coming back anymore

these private clampers are going to get more common
there even clamping over in the spawell car park now
where we have used as a meeting point before
big car park 1 or 2 little signs you wouldnt even notice
and some lad sitting in a van just waiting to clamp :icon_rolleyes:
i hate them :angry1:
and there putting the price up in dublin city to 150
fookers :comp26:

From what i hear , clampers take a photo of your car at the seen of the alleged offence as evidence your car was illegally parked.

As far as I'm aware, if its a private clamping company, you can remove it and hand it back to them as long as you dont damage it. If its a local authority (city council or the like) it's an offence to tamper with it. Dont think the private ones have a leg to stand on legally

@ scooby king the only problem with that is commom law ie the law of the land isn't worth anything more than sh1t these days, the private ones are a joke as colm said waiting to clamp you, scumbags

You'd hope so, but look at what Dublin City Council did to a member on DTD.

For private companies, simply drop the wishbone and pull the clamp off and ring them and tell them where they can find the clamp. Just don't damage it. If you find they damaged your car then call the Gardaí. Don't mention clamping cause they wont bother coming out. Just say someone has vandalised your car and ask them to send a car out.

hate clampers

look out for cameras

remove and dispose of if possible

deny everything

100% agree Ken..it's a legal grey area..If the signs are not visible on the way into the area and visible from all 4 sides it's an illegal clamp...you remove an illegal clamp you are perfectly within your rights to remove it.

What sparked up my interest was recently being in the Local Hospital Carpark, where they now have a Company in clamping, i was waiting to collect the Woman. in a set down area, which was i think max 20 mins stay. I was watching my time but noticed that the clamper was watching me like a Hawk. I know if i had of got out of the car he would have clamped it, if he had of come over and i in it i had myself so wound up i was going to break his nose :)
Even the Nurses were warning patients to tell their partners/ relatives to be carefull as the clampers were Ruthless..

It seems to me to be a very grey area, not much different than me having a sign on my drive way saying any car that enters will be seized... does that give me the legal backing to seize your car if you drive into my drive?
Just because you have a sign up saying your dog bites, doesnt mean he legally is allowed to
