Customs / VRT Problems

Yogi

Petrolheads
To try and cut a long story short. Customs paid house a visit on Saturday regarding my un registered e36 BMW outside the door.

I was not there, but my mother was. She told them that I was using the car for parts, to which they said "we say the boxes of parts in it alright". She said that it was mine and gave them my name and mobile number.

Yesterday then I got a leter in the post from them demanding payment for the VRT.

I hope to take a few bits off the car, as I have a second one that I'm building, and sell it as a track car or for breaking.

They said that if I'm to make any use of it, even track days etc, that I'll have to VRT it. Personally I think that's rubbish. How do rally boys get away with it? If I don't VRT it, and want it for parts I'm supposedly going to have to cut the chassis and render the shell useless.

Does anyone have any links to the loop holes and exceptions to VRT that would sort me out in this case?

Pretty badly stuck here. Can't hide the car and hope they forget about it or can't find me or the car. They have my name, address, mobile number and the car reg...

I'm sure STi Garda or Frawls will come along to give you a definitive answer but afaik you only have to register a car to drive it on the public roads, if you want to strip it or convert to track car then you don't have to VRT it (that of course assumes you bring to track on a trailer)

Thought the same myself too Brian, but these cnuts in the VRO think otherwise.

Will call into my local garda station about it too, to see what they tink. Sound bunch of lads in there. Just want to get decent legal documents to back my case up before I go into them to give my sob story.

Did a neighbour report it or something?

if the car is on a public road etc it needs to be registered most rally cars arent parked on a public road could you not park it in a garage

Without having a look at the legislation on this I am inclined to Agree with STI Brian. As long as the car is not used on the public roads then I dont see why it should be subject to VRT. After all VRT is a tax on first registration. If you want to register it in your name then you will be stuck with paying the VRT but if you just use it as a track car and trailer it to the track then I think you should be ok.

As I said I'm just speculating so I'd advise you to have a look at the Revenue Commissioner's website on the matter. I'm sure you'll find the answer there.

Unless you are driving it and willfully hand over the keys when they stop you there's bugger all they can do.
It's not a common know fact but the customs cannot sieze a vehile worth for example 15k just to make you pay 5k vrt.
Cheers
John.

PS they are the lowest form of scum on the planet- tried to take my cousins car off her outside the graveyard at my Grandads funeral.
She's got a northern company car but lives in Donegal.
My only question to them was "it must be terrible to be in a job who no matter who you speak to thinks your a pri*k"
Didn't get an answer :ponder:

seems to be alot of activity regarding vrt lately was talking to two people in the last few days that also got a visit from them same bul****t were going to take your car unless etc etc, they told one of them that there next call was to the local parish priest  seems hes been drivin around for about a year wiyhout paying the VRT  and i thought all priests were holyier than though   :dunno:

driving through ardee town earlier and customs in a silver mondeo had stopped a northern reg 02-03 laguna..

never seen the likes of that unless a customs checkpoint..

but not like that in a town....

so obviously been told to get off their holes and get bit revenue in...

Customs have been around Drogheda quite alot recently. So as Davelegacy said they must've been told to do some work!! W@****s!

im the last person to be talking to bout this, have ya seen my reg

the only advice i can give ya is drive hard enough so they cant catch ya :smokin:

i do agree with fraws though, i think there is legislation there bout cars not bein used on public roads
but on the other hand failing to transfer details also has legislation, ill look into it further
an let ya know

Sti Garda :smokin:

just on the question whats the story if you have a uk registered car and a uk license that you just havent got around to changing to an irish one can you get away with the vrt then ???

you need to prove residency in the uk?

example valid tax
valid insurance
valid licence
valid address

then can't touch you..

Track cars don't need to be imported if they are being transported on a trailer to and from the track. Rally cars on the other hand would need to be imported unless you have an address in the UK or NI, as they are driven on the public road and are subject to tax, NCT and insurance just like any normal car, as rally insurance only covers you on the special stage section.

Also it is my understanding that the law is that you have only a couple of weeks to put the car on an Irish reg, but if the car is not in plan view then you can get away with it for a long time. We only cleared our rally car back in December after buying it in March '07, 'cos it was stored at my mother in laws farm so no one saw it.

This country is such a rip-off they've nothin better to do with there time why dont they go after half the cars that are actually on the road that shouldnt be

section 140 finance act allows customs or gardai to impound any foriegn reg car for an initial period of 30 days to establish its details in its country of registration. for example ringed, stolen usual stuff. Car doesn't have to be out of the drive way for that, but if they want you to pay the vrt you must be stopped driving the car as using an unreged car is the offence, if its in your driveway remove the battery or even the 4 wheels, so you can show em its not moving. another point is that if you intend to reg a foriegn car here u must do so within 24 hours of import otherwise your screwed on penalties.

Oh yeah that initial 30 day impound costs you 35 yoyo's a day
