Garda Seem to hate scoobys

I rang the Traffic corps today,
He told me that under taking is a pointable offence and obstructing the overtaking lane is also an offence!
He said he would sooner do the lad in the fast lane!

Based on what you were saying I thought the Rules of the Road had changed.

Guess what they haven't - you've always been allowed pass on the left.

Here's what the Rules of the Road say:

You may overtake on the left when
  • You want to go straight ahead when the driver in front of you has moved out and signalled that they intend to turn right
  • You have signalled that you intend to turn left
  • Traffic in both lanes is moving slowly and traffic in the left-hand lane is moving more quickly than the traffic in the right-hand lane

So if you pull into the climbing lane and are not speeding then you should be OK to pass the guy. This was one of my questions at my test.

Cheers, P

Basicaly what's going to make the differnce here is :

Did you change from the overtaking lane back into the slow lane and then
proceed to undertake the other car ????? and based on what you said in your first post

YOU DIDN'T ..............so definitly go to court and plead your case to the judge .

Niall.

I've never had any major problems with the Garda, once your taxed, tested and insured and not driving like a muppet they usually leave you alone. Only prob I had was my little reg on the front which I haven't got around to changing yet lol, its so pretty though lol

You're quoting the rules of the road but still coming up with the wrong answer. The third situation above refers to traffic moving slowly, e.g. in queues or in heavy traffic situations. It doesn't mean you can undertake the guy in the fast lane on an empty dual carriageway if he's doing 50 and you're doing 55.
