Im very upset guys, my dog bit my neighbor,, advice please..

jesus fella sorry to hear this but i reckon dont do anything to rash , as said above by nick and few of the lads she was on your property and has no proof of the nip your dog supposidly gave her , if she didnt report it before maybe ya'll be safe enough , make it out that she has a vandeta against you and your dogs , i'd do anything to save my dog if was in same position as yourself
 
Totally agree with Duffman on the biting issue but this didn't seem to be a bite or attack. :dontknow: Shouldn't be a problem rehoming him as it wasn't an aggressive action. Anyone who knows collies knows this behaviour, and would be happy to take him.

This was a herding nip. I'm sure he warned her, and warned her again (head and ears down, tail up, dancing side to side and barking). But due to her ignorance of dogs she continued to advance (or maybe even run which is the worst thing to do) which elevates the dog to the next level, sneek behind and then a nip. This is the herding instinct. This is not an attack. He didn't want to fook her up, just get her moving out of his garden. Which in fairness he did.

If he is not neutered get it done ASAP. :new_puppy_dog_eyes: This often helps reduce the territorial side in them and also a lot of other undesirable behaviours.

Also argee with Duffman in that the dog should not be roaming around the gate. In the photo you have an electric fence collar on him? Does the boundary allow him to access the gate? Seems to be partly your fault and partly her fault due to a slight lack of knowledge of the breed. :doh: Not really the dogs fault as Duffman has also siad.

Yeh the dog cant go near the gate.. that hole space between the house and the gate the dogs have never been..
 
Ian, Don't mean to be a postwhore on this but found something that may be some help to you:

Firstly I'm not a solicitor so may be way off here, but from "Control of dogs act 1986"

Liability of owner for damage by dog. 21.—(1) The owner of a dog shall be liable in damages for damage caused in an attack on any person by the dog and for injury done by it to any livestock; and it shall not be necessary for the person seeking such damages to show a previous mischievous propensity in the dog, or the owner's knowledge of such previous propensity, or to show that such injury or damage was attributable to neglect on the part of the owner.

(2) Where livestock are injured by a dog on land on to which they had strayed, and either the dog belonged to the occupier of the land or its presence on the land was authorised by the occupier, a person shall not be liable under this section in respect of injury done to the livestock, unless the person caused the dog to attack the livestock.

(3) A person is liable in damages for any damage caused by a dog kept on any premises or structure to a person trespassing thereon only in accordance with the rules of law relating to liability for negligence.

( 4 ) ( a ) Any damage or injury for which a person is made liable under this section shall be deemed to be attributable to a wrong within the meaning of the Civil Liability Act, 1961 , and the provisions of that Act shall apply accordingly.

( b ) Sections 11 (2) (a) and 11 (2) (b) of the Statute of Limitations, 1957 , shall apply to such damage.

If you look at paragraph (3). Reads to me that if someone is tresspassing you are liable only if negligence can be proven on your behalf. You were using radio fences and you say your dogs don't have access to the front door/gate part of your house. Did she not enter an unusual area of your garden that was not protected by the radio fence? Is this negligence on your behalf?

Also legislation only refers to "attacks" and "damage". Was she actually "attacked" by the dog? Is herd nipping deemed an "attack"? Would every farmer in the country have these dogs attacking their herd every day? Was there any "damage" or just a scratch? Has she any evidence of an attack or damage? He herded her :icon_grin:, not "attacked" her.

Might be worth giving a solicitor a buzz or maybe call a dog warden, (on private number or payphone) at the other end of the country from you with a "purely hypothetical" question?
 
Get a friend to mind the dog for a few days,when the warden comes say it went missing,bring it back a few days later, and mantain its a new dog without photographs of the dog they cant prove that its the same dog that bit the women.and cant do anything about it,happened to a friend of mine when a teenager jumped over his fence to get a ball,and thats what he done and it worked. :thumbsup:
 
I'd be sayin to her with a watery eye that your dog is gonna be put down because "you were in my garden" she might see it in a different light and just stay away in future.
 
She Rang while i was out, asking what time he was booked in,, toughboating bitch has had it in for my mum since the 80's dont ask me why.. one of these woman things,, think she is just glad to get the one up..
 
if thats the attitude she has, call her back and tell her that the only thing booked is a meeting with your solicitor to discuss the fact that she was trespassing on your property :angry1:

What a silly c*%@ of a woman. She should've known better if the dog bit her before. She probably did it on purpose if she has a history of having it in for your mum as you said. I wouldn't back down so easily for her at the end of the day she trespassed twice!
