legal question!!

Sunday Drivers
Okay well I received my first ever fixed penalty notice for speeding today after 9 years of driving, go me right, and I'm hugely confused. It says I was clocked doing 62 in a 50 zone. My confusion is this: the stretch of road in question is signposted as a 60 (I still excreeded it I know but by 2kph) now the 60 zone in question does reduce to a 50 and I thought maybe that part of the road was called the same but I did a few map checks and am 99.9% sure it's different, even the guarda map of where the speed traps are has it at a different name. Can I find out which part of the road the camera was on? Who do I get in touch with? Do I just pay the fine and take the points? What do you good people think?

Enquiries in relation to a Fixed Charge Offence
If you feel there has been an error with any details on the Fixed Charge Notice, then you should contact the Fixed Charge Processing Office by telephone at 1890 30 40 60 within Ireland or +353 504 59800 from outside the jurisdiction or by email at [email protected] where you will be advised by a member of staff regarding your enquiry.

I'd say that's your first course of action. As per the Garda website....

I'd defo query which stretch of road it was taken on.
I mean if it is 60 km/h zone and not 50 km/h then the details of the ticket is incorrect.
I'd say the'd be likely to still fine you for 62 in a 60 zone especially after following it up, but then maybe not

Follow it up, similar happened to me about 3yrs ago. Clocked going 110 in a 80 but it was actually in a 100 zone. Ticket and points were dropped even though i was 10 over.

Ring them!!!

Thanks for m the replies. Rang this morning and got a cantankerous old garda, after what felt like an age explaining the situation was informed that it wasn't really his place to say what the speed limit is there and that I should contact the local superintendent I rang his office and got a very unhelpful Secretary who just told me there are signs with the limits on them!! So I went to the local station and asked what the speed limit was on the road in question and the ban garda, who might I add was very attractive, confirmed it is a 60 zone. I then showed her the notice and was rather bemused by it and told me it would be very harsh if it was carried out. She told me that I have to appeal it in writing to the superintendent. She says it could go either way what with all the fuss lately about penalty points but that it would be worth the try as it's pretty clear I have a pretty strong case and that if the super does nothing a judge most likely would throw it out if it got to court. Might have a word with a legal person before that though just to be sure

if it did go to court even the smallest discrepancy will see it thrown out.
i have seen guys get off drink driving charges for misspelt names or addresses

Whoever clocked you speeding was probably parked in a 50 zone but clocked you while you were in the 60
Happened me before, the guard was standing in a 30 but I was still driving in the 50 when he clocked me
Didn't matter to me as I was speeding in the 50 anyway :new_puppy_dog_eyes:
