Sickened - First 2 points

Sunday Drivers
The reason why its hard to respect the law at times.

I had my own run in this morning with the Gardai.
I over took on a solid white line.

I'd been behind a small lorry (no trailer) carrying gas bottles, doing roughly 25-30 km/h in a 50k zone, id sat behind it going up a very gentle hill (in killcock while heading towards the Motorway) the solid white line continues on down the hill way further than it needs to.
When i reached the top i could now see the whole way to a roundabout (200m or so away) so I proceeded to safely overtake the truck all without breaking the 50km/h limit.

As soon as i got along side it, the blue flashing lights came on, there was a cop car parked on the right hand side of the road facing me, that had seen the manoeuvre.
I'd seen it also, it was a people carrier type thing, and I waited till I got close enough to see it, and decided it was a travelling doctor or something...how wrong I was.

Needless to say i pulled over straight away and he took my licence and said 2 points and the fine will be issued.

Now, if thats not synical, what is.
There should be a double white line on the hill, with it dashed on the down side of the hill in each direction.
I tried to argue my point but he was having absolutely none of it.

Ok, i over took on a solid white line (which shouldn't be there) which technically is illegal, but there was absolutely nothing dangerous about it, its a money making raquet, and he was being a total w#nker.

I bet if I was in my Van or another car he probably wouldnt have bothered, but saw a blue subaru and immediately said I'll get him!
He even said to me, so thats and 80 euro fine, and 2 points, I bet that will make it hard to insure this car, now that'll teach you to take your time. ( or something to that effect, as that stage I was sick of listening to him)
I was fairly sure the first time I got points it would be for speeding, but there ya go!

Shows what he knows-2 point will make no difference to insurance. I reckon theres an attitude installation machine down in Templemore-just do yer jobs lads and less of the smart sh1t-I bet yer wives love to see ye comin home....how was your day dear? Ill ask my questions first.

2 points is making the difference for me!

I have 2 of my own commercial policies which 2 points dont matter.

The scooby ended up going in the Ma's name as it was easily the best deal.
Its an open drive over 25 with full "Clean" irish licence.

Unfortunately that now rules me out.....Doh!

do insurance companies even check have ya points or do they just take your word on it?

does clean not mean no endorsements or that,
as i always understood up to 2 points was regarded as normal

I think they take your word, but still.
If you had a crash, and they went looking its a way for them to not pay out.

der all out for promotion dude
you could take it to court and mayb just the fine
but it could go the other way just asked the bro in law and he reckons if u go u just get the fine
but still depends on the judge

they have to pay out anyway, then they collect from the mibi, then 10 years down the line the mibi come after you for the claim.
thats when your screwed if you own anything.

it was said above that insurance companies have to pay out even if you havent told them about your points........

CATAGORICALLY untrue

Insurance companies will do anything to get out of paying out for a claim, If you fail to mention something to them then they can null and void your policy without prior warning. Its all in the small print and in their terms and conditions........

DO NOT give them any opertunity to refuse to pay out on a claim that may come from an accident.

I understand that you say the solid line is not necessary, however a road safety auditor has probably already decided it is necessary in the past...... I know from a drivers point of view I would say things are wrong, however if you look at it from the point of view that some dottery old dear is comin down there at 30kmh and her vision is failing she wouldnt be able to see what you can or pass as safely as you can! Im a Traffic Safety Control Officer, and work closely with road safety auditors so i know how they think..... They look at the full spectrum of road users not just the competent drivers!

Therefore road markings are there for a reason! We all have the urge to pass someone on solid lines etc from time to time..... Its against the law no matter what we think....
Sorry to hear bout the points but I honestly wouldnt advise fighting it!

I think your right, just take em on the chin, not worth risking getting 4 points.
However, the point I made earlier saying that it should be double solid white lines on the way up the hill from either side, and then dashed white on 1 side and solid on the other once you've reached the crest should still be the case, for any hill on a straight in my opinion.
