Went to a birthday party tonight in the Hilton on the Malahide road. Great night :icon_blahblah: :icon_blahblah:. Left my car at home because it was the girlfriends turn to drive and i'd have a few drinks. Shortly after we'd left a garda car came up behind us and pulled us over. Girlfreinds only a learner but i had my license with me.

Anyway he checks the discs and then says to her that he was going to breathalyze her because he'd seen us coming from the hotel. Obviously she passed but then to my shock he comes to me and tells me i have to get done too because i was her accompanied driver. I've failed and the cnuts turned round and given me a ticket for a €125 fine!!! :angry1: :angry1:

I know i'm meant to be sober while i'm in the car with her but i didn't think they would do something like that!!! The fine is for public intoxication or something along those lines.

I though they could only do you if you where in control of a car, as an accompaing driver you would be clear.

Thats what i thought. He wouldn't even explain the ticket to me. Just kept saying that i have to be below the limit when i am her accompanied driver!

DOn't think so I'd first of all go to the police station and ask to see the shift Sergant and if I got no joy I'd go to a solicitor as the whole point of you being a passenger is so you didn't drink and drive.

To question it, would i have to go to that gardas station?? And if so what would be the local station for the Malahide Road?

Go to the Garda ombudsman in Abbey street and take it up with them. I think the accompanying driver does have to be uner the limit, I remember reading something about it before

yeah mate!!!!
because shes only a learner driver, the accompaning driver has to be capable of driving the car should anything happen to the learner....
i.e.... a learner is not allowed drive on a motorway even with a full licensed passenger!!!!
he was obviously being an arsehole but within the law!!!!

We weren't on the motorway Mark. We were heading up towards the Bewleys Hotel to go into Swords along the back road.

Fcukin hell thats shockin :wall: :wall: i mean you try and do the right thing and not drink and drive and then you end up gettin done for havin a few drinks anyway :icon_jook: thats just some garda lookin to do someone for something its things like this that do my nut!!!!! :hammerhead:

Just been down to the local station to ask about it. They said that the Garda was well within his rights to issue a fine. The woman said that i'm lucky that my girlfriend didn't get the €1000 fine for learner driving without an accompanying driver as supposedly the garda could have said i was not classed as one because i had drink on me. :angry1:

The whole thing is starting to get confusing so i think i'll have to go and see further about it.

This is the law under the new learner driver laws that came in a couple of months ago.

I actually understood it to be that you could be prosecuted basically as a drink driver even in the passenger seat.

Not being a pri*k here but the cops are just going to recycle the old line, ignorance of the law is no excuse.

Sorry :icon_cry:

Just after being told this. So maybe looking back on it i've probably got off lightly!!!

What a crock of Sh1t , i would look into it further as if it is the law 99% of the population wouldnt know about it
Its gobshites like that give all Garda a bad name :angry1: :angry1:

this is what pisses me off, they bring out these laws and you have to wait till you break one before you find out about it, and if you go looking for the relevent information they look at you as if you have two heads. the older and wiser i get the less time i have for the gaurds. sometimes when they nail you ye might deserve it but more often then not its an abuse of power and more revenue for the goverment. if for some reason the learner drive couldnt complete the journey it would be a simple case of parking the car up and getting a taxi, its like there punishing you on the basis that you might get in and drive the car with drink on you if something happend to the learner...what a crock of shite

When you are supervising a learner driver, you have the same legal responsibilities as if you were driving. For example, the drink drive laws and the ban on using mobile phone applies to anyone who is supervising a learner - you are deemed to be in control of the vehicle.

to be honest mate be glad you aint loosing your licence... so I wouldnt go near the Garda or complain about it.. and thank your lucky stars,

we dont always agree with the Law :new_argue: but we cant do alot about it....
