DAMAGE Discovered-What are my rights?!

Afternoon All,

Bit of a story here.

This morning the steering on my 99 legacy b4 started pulling quite badly to the left after taking a sharp left turn at the strawberry beds coming up the steep hill towards clonsilla.I had to stop on full lock on the apex of the turn as there was someone in the yellow box. From that point the steering was pulling quite hard to the left. The power steering doesnt seem to be affected, the wheel is still fairly easy to turn although there is a slight increase in effort.

So i brought the car to fast fit in coolmine to have it tracked. From my explanation they were suspicious as to whether in fact it was the tracking.Anyway they brought it in & measured up,indeed the tracking was off,but they said it was the drivers side was off by more -2.8 as to -1.7 on the left.So i agreed to have it tracked.Car was then raised on the ramp & when the lad went to adjust the rear he found damage illustrated by the attached.

The damage is located on the drivers side, just foward of the rear wheel,I think its called a camber adjustment plate?

So at this point the guys informed me that the car is not in a road worthy state "a death trap" they put it.So rang the dealer who sold the car.I explained the issues with the car & have since emailed them the picture. They were very accepting of the problem. They said bring the car over 1st thing monday morning.Which is fine by me.

My questions for the members are:

What are my rights?

Am I entitled to seek a full refund? I traded in my old corsa plus cash against the legacy.

The warranty only lasts 3 months,Is the dealer still liable for the damage & indeed any other damage that maybe on the car?

Northside automotive want a snag list from me for monday, what else should i put on it?,any mechanics here want to give the car a going over?,available today, tomo & saturday

Lastly any other advice?

any chance the bolt worked itself loose overtime? i cant imagine a garage checking for stuff like that, when they bring cars in, Is it still under warranty? If so shouldn't be a problem. You might not be able to get a full refund since your Corsa may already be sold onto a different garage. Definitely think you have a right to repair, If it is out of warranty, don't think you have much of a come back :(

Possibly the bolt has worked its way out,but the gouge from the grinder didnt happen by accident,im 99% sure it was crashed but it passed the NCT,this is my problem NCT said it was road worthy, the gouge was there at the time but it was missed so my NCT is void really.

Replaced/repaired steering wheel for sure.

They never said it was crashed.

What sort of mileage is on the car? Cant see it being able to working itself out unless its done massive mileage

Done 5000km since i got it,78500k on the clock at the moment.

Rang the consumer agency they said they have to repair it,but a refund option would most likely end up in court

I'd ask ciaran (RS-RA) to have a look at the car if he has the time... He'll go over it completely and tell you if there's something wrong... A good crash repair place might be able to tell you where there has been bad body damage and a respray...

ive heard good thing about northside automotive when these things happen......

mate of mine had an fto, he had the car a week and the front two tyres exploded going round a corner a week later, they replaced both tyres and fixed the camber.... no arguments just bring her in.

from the pic it doesnt look that bad - could something other than a crash have caused this?
maybe it happened in japan? most exporters guarentee the car hasnt been crashed or clocked..
maybe theres something in that...
such a pity ---such a lovely car

the grinder mark would suggest that the missing bolt was a problem to remove(ie. seized)...
wouldnt jump striaght on the bandwagon and say it was crashed....may well be a proper explanation!!!
let the garage deal with it and see where they go with it!!!!
i would be disgusted with the NCT for missing something so visible like that....
i wont get into a slagging match over this garage either as i've a mate who had serious dealings with them and never again!!!
good luck mate!!!

I'll take down the post now as it looks a bit odd now its changed lol, hope you get sorted anyhow either way.
